The simplified joint stock company ETUDESK (hereinafter "ETUDESK SAS"), based in Côte d'Ivoire, specializes in education technologies and has set itself the mission of improving the learning experience through the world.
The etudesk.com platform (hereinafter “the Etudesk platform”) is a product of ETUDESK SAS. It is a cloud-based, online learning platform referencing training paths developed by companies, universities and other institutions. Learners benefit from regular monitoring, with business experts, in order to learn more easily and acquire professional skills.
As used herein, the terms "you", "your" and "your" refer to Visitors and Users, and "we", "our" and "our" refer to ETUDESK SAS.
We are committed to a continuous process of compliance with the various regulations on the protection of personal data such as: Ivorian law n ° 2013-450 as well as the European directive concerning personal data (RGPD).
This privacy and cookie policy describes how we collect, use, store, protect and disclose data that we may collect from you or that you may provide to us by visiting or using our web and mobile services. This policy is an integral part of our general conditions of use and of each internal rules for Learners published by an Administrator for his private e-learning platform.

We may collect and process information that you voluntarily communicate to us or that is collected automatically when you browse the Etudesk platform. In the first case, the information concerns the data you provide to complete a registration form for a training course or a form for creating a private e-learning platform:

A cookie is a text file generated by the servers of the websites you visit and stored on your device (computer, smartphone, tablet, mobile, etc.) from your web browser.
This file records information relating to your browsing on the Etudesk platform in order to optimize and personalize our services based on your preferences, to identify you when you access your customer account, to keep your session active when you browse a page to another, as well as to provide statistics on user profiles.
We are committed to storing only your interactions with the Etudesk platform. However, some third-party services that we use, such as Google Analytics, may place their own cookies in your browser. This privacy policy covers the use of cookies by ETUDESK SAS only and not the use of cookies by third parties.
The first time you browse the Etudesk platform, a banner is displayed. Subject to your choice, cookies will be stored in the memory of your device. They are valid for a maximum of thirteen (13) months from the day you gave your consent to the integration of said cookies.

If you are reluctant to use cookies, you can manage and control them at any time through your browser. Indeed, it is possible to configure your web browser to deactivate or activate cookies; but this may interfere with the use of some of the functionality of the Etudesk platform, which explicitly requires cookies to function properly.
Your collected data can be used in the context of user management, in contacting an educational instructor and finally to respond to your requests or to send you regular notifications and information on educational paths.

Certain data collected helps manage the Etudesk platform and perform internal technical operations as part of problem solving, data analysis, tests, research, analysis, studies and surveys. This processing is based on our legitimate interest in ensuring the security of the Etudesk platform and improving its characteristics.
We use analytical tools (for example, Google Analytics and functional cookies) to provide you with personalized journeys and generally improve your user experience. These tools also make it possible to establish statistical studies on the traffic of users of our platform.
We keep your data collected throughout your use of the Etudesk platform.
Your collected data will be immediately deleted when you cancel your subscription or registration.
Your data will be archived after a period of inactivity of 5 years. We reserve the right to keep your email secure in order to allow recovery of your account in the event that you forget your password.
If your account has been suspended or blocked, we keep your data for a period of 2 years from the suspension in order to avoid any circumvention on your part of the rules in force on our platform.
Right of access : you have the right to receive a copy of your collected data.
Right of erasure and right of rectification : you can request the erasure of your collected data as well as the rectification of erroneous or obsolete data. Please note that we may retain certain information about you when required by law or when we have a legitimate reason to do so.
Right of opposition : you also have the right to oppose at any time for reasons relating to your particular situation, to the processing of your data for direct marketing purposes or to processing carried out on the basis of our legitimate interest.
Right to limitation : you have the right to limit the processing carried out on your personal data. Please note that this right only applies if (1) you dispute the accuracy of your personal data for the period allowing us to verify the accuracy of the latter; (2) in the event of unlawful processing on our part and you demand a limitation of their use rather than erasure, (3) we no longer need the personal data for the purposes of the processing but they are yours still necessary for the establishment, exercise or defense of legal claims; (4) in the event that your right to object is exercised during the period of verification as to whether the legitimate reasons pursued by us prevail over yours.
Right to portability : you have the right to receive your personal data (provided directly) in a structured, commonly used and machine-readable format and the right to transmit these data to another controller.
You also have the right to define directives relating to the fate of your personal data after your death.

We take care to protect the data you choose to communicate to us, in order to ensure its availability, integrity and confidentiality: to prevent it from being distorted, damaged, destroyed or disclosed to unauthorized third parties.
We apply technical and organizational security measures to prevent any loss, misuse, unauthorized access or dissemination, alteration or possible destruction of this data.
The Etudesk platform is based on the Amazon Web Services cloud infrastructure (hereinafter "AWS"). This deployment infrastructure meets the most stringent security requirements in the world (ISO 27000, CSA, SOC 1 - 2 and 3, PCI DSS, NIST ...).
We operate the Amazon GuardDuty service for continuous monitoring and detection of unauthorized network activity; the Amazon Web Application Firewall service to protect our platform against the most common web vulnerabilities that may affect its availability and compromise its security; one of the most advanced encryption technologies available to the public to secure your data: using SSL (TLS 1.3) and SHA-256 certificates with 2048-bit RSA encryption, we encrypt your data at rest as well as all incoming network traffic and out of our infrastructure. Our software infrastructure is regularly updated with the latest security patches. In addition, we integrate the rotation of credentials into the management process of our cloud services participating in the commissioning of the Etudesk platform.
We protect your billing information. This information is transmitted, stored and processed via secure APIs from our service providers (STRIPE, CINETPAY). These service providers offer the best security guarantees in terms of financial transactions via the Internet.
We use a data storage infrastructure offering scalability, high availability and cutting edge performance: Amazon Simple Storage Service (S3) and Amazon Relational Database Service (RDS). Your data is stored replicated on 2 separate AWS locations, located in Paris, physically independent and highly protected against local outages (power outage ...). A full backup copy is made every day at one of the locations.
Although we strive to protect your data, no data transmission over the internet can be guaranteed to be 100% secure. Therefore, you acknowledge and agree that we cannot guarantee the infallibility of this protection due to unavoidable risks that may arise during the transmission of your data.
As all your data is confidential, access is limited to our employees and service providers who need it in the performance of their mission. They will be required to process your data using the Google Suite web service, whose servers are located in the United States. G Suite's secure cloud infrastructure and applications are designed to meet strict standards of privacy, transparency and security.
All persons with access to your personal data are bound by an obligation of confidentiality and risk disciplinary action and / or other sanctions if they do not comply with these obligations.
However, we recommend that you do not share your password with anyone, change it frequently using a combination of letters and numbers, and make sure you are using a secure web browser. We cannot be held responsible for activities resulting from your own negligence in keeping your password and username secret. Please notify us at yves-rosaire.kadjo@etudesk.org as soon as possible if your user account is compromised.
The Etudesk platform may contain links to other websites. We are not responsible for the content, accuracy or opinions expressed in these websites, and these websites are not the subject of any investigation, monitoring or verification for accuracy or completeness by us. The inclusion of any linked website on our Etudesk platform does not imply endorsement or approval of the linked website by us. If you decide to leave our Etudesk platform and access these third party sites, you do so at your own risk.

Ces personnes pourront être amenées à vous contacter directement à partir des coordonnées que vous nous avez communiquées.
Nous veillons à ce que les sociétés partenaires acceptent de traiter les informations collectées sur notre plateforme exclusivement pour leurs besoins et conformément à nos instructions, dans le respect de la réglementation et s'engagent à mettre en œuvre des mesures appropriées de sécurisation et de protection de la confidentialité des données.
ETUDESK SAS ne vend ni ne loue vos données à des tiers à des fins de marketing, en aucun cas.
Nous pouvons divulguer vos informations si nous sommes contraint par une autorité gouvernementale ou un organisme de réglementation, en cas de réquisition judiciaire, de citation à comparaître ou de toute autre exigence gouvernementale ou judiciaire similaire, ou pour établir ou défendre une demande légale.
Nous veillons à ce que les sociétés partenaires acceptent de traiter les informations collectées sur notre plateforme exclusivement pour leurs besoins et conformément à nos instructions, dans le respect de la réglementation et s'engagent à mettre en œuvre des mesures appropriées de sécurisation et de protection de la confidentialité des données.
