This site is published by the Société à Action Simplifiée ETUDESK (hereinafter “ETUDESK SAS”), a company with a capital of FCFA 1,334,000, whose head office is located in Abidjan Cocody II Plateau Angré Cité les Papayers, Interconfimo building 4th floor Apt. These General Conditions of Use (hereinafter the "T & Cs") govern all use of the etudesk.com web platform (hereinafter "the Etudesk platform") and its content.
The Etudesk platform is an online learning platform offering project-oriented training paths. It enables the creation, monitoring and efficient management of training programs accessible to learners via computer, tablet and smartphone.
These T & Cs are concluded between the person or entity wishing to use the Etudesk platform to distribute training content accessible anywhere and on any device, access the progress of its Learners at any time, evaluate them and interact with these last (hereinafter, the “Administrator”) and ETUDESK SAS.
As used herein, the terms "you" and "your" refer to the Administrator, and "we", "our" and "our" refer to ETUDESK SAS.
By accessing or using our Etudesk platform, you are deemed to know, understand and accept these T & Cs and our privacy and cookie policy .
We are free to modify these T & Cs at any time, in order to adapt them to changes in our Services but also to take into account any legal or regulatory changes. We invite you to refer to it as often as possible in order to become familiar with it.
We reserve the right to take all necessary measures against an Administrator who does not respect them.
If you do not agree with these T & Cs, you may not use or access our Services.
Terms beginning with a capital letter within these T & Cs, whether used in the singular or in the plural, will have the meaning given to them below.
"Service" : ETUDESK SAS offers as services, the operation of an online training management system and its involvement in the creation of training content and its technical assistance.
"Visitor" : refers to any natural or legal person, Internet user, browsing the Etudesk platform without being connected to a user account.
"User" : designates any visitor who has created an account to access the functionalities of the Etudesk platform.
"Learner" : designates any user, authorized by an Administrator, to follow a training course.
"Instructor" : designates any user, authorized by an Administrator, to contribute to the development of the training course as well as to assist one or more learners in carrying out their project.
"Subscription" : means a subscription agreed between ETUDESK SAS and an Administrator for the same service offered in several installments or over a given period.
“Bounce rate” : also called “Bounce rate” represents the percentage of e-mails sent by an Administrator to invite Learners to register and follow his training courses, and which are not not reached the recipients due to an address error.
You may not access (or attempt to access) the Etudesk platform by any automated method. Accounts registered by "bots" or other automated methods are not allowed.
When subscribing, you must provide your full legal name, a valid email address and any other requested information in order to complete the registration process.
We recommend that you use a password with the following characteristics: at least 8 characters long; a special character; a capital letter; and, a number.
You represent that all the information you provide is accurate and up to date. You agree to keep and update this information in the event of changes. You agree not to create a false identity likely to mislead third parties and not to usurp the identity of another person.
We pay particular attention to the protection of your personal data. You will find in our privacy and cookies policy the detailed description of the uses we make of your personal data, cookies and their purposes. As mentioned in this policy, We reserve the right, but not the obligation, to record your access to and use of our Services.
You can delete your account at any time from your profile. All personal data and course progress data linked to your account will then be deleted.
Your subscription to the Etudesk platform can begin with a free trial. The duration of the free trial period is fourteen (14) days, and it is intended to allow Administrators to try our Services.
You are not authorized to create multiple Administrator accounts in order to benefit from this trial period.
We reserve the right to determine your eligibility for a free trial and to limit it, and its duration, to prevent abuse of the free trial. We reserve the right to revoke the free trial and suspend your account if we determine that you are not eligible.
During the term of your subscription, we grant you a non-exclusive and non-transferable right of use allowing you to:

You must not, under any circumstances, adapt, modify, translate, arrange, distribute, decompile the Etudesk platform.
In particular, you agree not to reverse engineer the Etudesk platform with a view to developing a competing product or service and / or to copy, reproduce any functionalities, functions or graphic attributes of the platform.
At the end of the trial period, you are prompted to pay your Subscription fees to continue using our Services. A valid credit card is required to make payment through our secure payment interface. Please see our privacy and cookie policy for more information on our online payment system.
In the event of non-subscription, once the trial period has expired, we undertake to keep your data for six (6) months.
Each year, on the day of subscription, you authorize us to automatically debit your bank account. In the event of a change of credit card, you authorize us to continue withdrawing this bank account.
Your invoice must be paid within thirty (30) days of the date of issue. If the settlement of a payment fails due to card expiration, insufficient balance or any other reason, and you do not terminate your account, we may suspend your access to the Etudesk platform until until we have successfully withdrawn your account.
You can unsubscribe at any time and you will continue to have access to the service until the end of your billing period. Payments are non-refundable and we do not give refunds or credits for periods of partial use.
In the event of non-renewal or termination, we undertake to keep your data for one year and subsequently delete them.
We reserve the right to revise the price of access to our Services by notifying you by email via the administrator account. This new rate will take effect fourteen (14) days after this notification. You have the right to terminate your Subscription during this period. Continuation of the Subscription will constitute acceptance of the new price.
You retain full ownership of the data you host on the Etudesk platform. We reserve the right to duplicate them for hosting and backup purposes.
We are and remain the exclusive owner of all copyrights, trademarks and other intellectual property rights as well as any other property rights relating to the Etudesk platform, specific interfaces and developments, user guides and documentation therein. related.
We guarantee that we have all the rights necessary for you to have access to the Etudesk platform, provided that you use it in accordance with the provisions of these T & Cs.
By subscribing to our Services, you acknowledge and agree that we will process your name and email address to communicate with you for the presentation and promotion of our Services or new services. You can unsubscribe from this electronic communication at any time, free of charge, by sending an e-mail to infos@etudesk.org
Anyone who has received your authorization to access this data is bound by an obligation of confidentiality and is subject to disciplinary action and / or other sanctions if they do not comply with these obligations.
In accordance with this policy, you acknowledge and agree that we communicate your data and that of your learners to our employees; to the extent necessary for the accomplishment of the tasks entrusted to them. These people may need to contact you directly using the contact details you gave us.

You are responsible for drawing up internal regulations in order to regulate relations between the members of your learning community, ensuring them better working conditions, conducive to the success of their training; and this, taking into account these T & Cs and our confidentiality and cookies policy.
You acknowledge and agree that our confidentiality and cookies policy is an integral part of the internal rules of your Learners.
We are responsible for providing you with a model of internal rules with the possibility of editing it on the "Settings" tab of your administration page, "Internal rules" section.
You are responsible for drawing up internal regulations in order to regulate relations between the members of your learning community, ensuring them better working conditions, conducive to the success of their training; and this, taking into account these T & Cs and our privacy and cookies policy .
You acknowledge and agree that our confidentiality and cookies policy is an integral part of the internal rules of your Learners.

You are responsible for all activity occurring through your User account. In order to maintain control of the account and prevent anyone from accessing it, you must maintain control over the devices that are used to access our services and must not share your password or details of the means with anyone. payment associated with the account.
You are responsible for updating and maintaining accurate information relating to your account. We may terminate or suspend your account in order to protect you and us and our partners against any identity theft or other fraudulent activity.
You are responsible for the legality, reliability, integrity, accuracy and quality of the content accessible from your private platform.
We may suspend or terminate your use of our Services and this Agreement upon receipt of any notification, which alleges that you and / or a User whom you have authorized, have used our Services for any purpose that violates any local and EU law, including including but not limited to the publication of content that may violate the rights of third parties, defame a third party, be obscene or pornographic, harass or assault others, pirate or other criminal regulations, etc. .
We reserve the right to suspend your ability to invite multiple learners when your Bounce rate is greater than ten percent (10%). We need to make sure that this feature is not used to send malicious, unsolicited or low quality emails. We recommend that you sort your learner list before sending out invitations.
The Etudesk platform is provided "as is", "as available" and without warranty or condition of any kind. In particular, we do not guarantee that our service will operate without interruptions or be free from errors. You waive any claim against us in the event of special, indirect and secondary damages. These T & Cs shall not limit the guarantees which cannot be derogated from or the provisions relating to consumer protection from which you may benefit under the legislation in force in your country of residence.
We take care of the corrective maintenance of the Etudesk platform.
In the event of anomalies observed, you must report them to support via infos@etudesk.org. We will proceed to a diagnosis and then to its correction:
We are not responsible for maintenance in the following cases: your refusal to collaborate with us in the resolution of anomalies and in particular to answer questions and requests for information; willful act of degradation, malicious intent, sabotage; use of the Etudesk platform in a manner inconsistent with its documentation.
We can carry out updates and functional evolutions of the Etudesk platform. These types of interventions can make the service temporarily unavailable: two (2) to five (5) hours of time between twenty-two (22) hours and three (03) hours GMT.
We have built security and resiliency throughout our operations. Our team uses the latest technology to make sure our infrastructure is reliable and your data is protected.
Although we work to protect your data, we cannot guarantee that unauthorized third parties will not be able to circumvent our security measures. Please notify us immediately of any unauthorized use of your account or the Etudesk platform by sending an email to infos@etudesk.org.
The Administrator and ETUDESK SAS (hereinafter "the Parties") undertake not to use and to preserve the confidentiality of any information they may receive with regard to the other Party, from all documents and information exchanged between them under these T & Cs, except for the strict needs of the execution of these T & Cs. This obligation will survive the termination of the Subscription for any reason whatsoever for a period of two (2) years.
This obligation of confidentiality and non-use will no longer apply in the event that the information and / or documents fall or have fallen into the public domain through no fault of the Party which received them, or in the case where a Party is required to respond to a court order or a request for disclosure from a public authority empowered by law, subject to informing the other Party so that the latter can present its arguments with a view to objecting to such disclosure.
These T & Cs are governed and interpreted according to the law of Côte d'Ivoire.
In the event of a dispute in connection with the execution of these T & Cs, the parties undertake a preliminary conciliation phase for a period of one month. In the event that no amicable solution during the aforementioned conciliation phase has been found, the parties agree to submit any dispute that may arise on the occasion of the interpretation and / or execution of these T & Cs, to the Court. of Abidjan (Ivory Coast) to which jurisdiction is hereby granted.
If one or more provisions in these Terms of Use should prove to be invalid, illegal or unenforceable, the remaining provisions will remain fully applicable and will retain their effects.
